Orunje is a technology medium designed to connect patients with local health care providers. Our services are offered through our website (http://orunje.com) and a mobile application (the “Application”) (collectively, the “Services”).

At Orunje, we take the privacy of your “Personal Information” and “Non-Personal Information” (defined further below) seriously and do our best to protect it. This Privacy Policy has been created to provide you with important information about the Company and our Services.

This Privacy Policy applies to all persons who download, access or use our website, Application or our Services, as well as those persons who register and/or provide us with information in connection with the website, the Application or our Services. By engaging in such conduct, you thereby accept the terms of this Privacy Policy. You further consent to the use, collection and storing of your Personal Information and Non-Personal Information as described herein.

We reserve the right to modify or change this Privacy Policy at any time, and without advance notice to you. Any changes to this Privacy Policy will be posted on the website and/or the Application, and will become effective when they are made available to you. We will always indicate the date this Privacy Policy was last updated at the top or the bottom of the page. Your use of the website, the Application and our Services after any changes or modifications to the Privacy Policy have been made, indicates your acceptance of the revised Privacy Policy.

WHAT INFORMATION WE COLLECT

When you interact with us through the website or our Application, we may use, collect and store Personal Information (including Protected Health Information) and Non-Personal Information from you, as further defined and described below:

  • Personal Information. When you use our Services, we may collect Personal Information from you (information that identifies you as an individual), including Protected Health Information (“PHI”). For purposes of this Privacy Policy, “PHI” means any information about your health status, the provision of medical services to you by a health care provider, or your payment for health care services (i.e. any part of your medical record or payment history).

    You may be asked to provide Personal Information and/or PHI in the following circumstances: (i) when you register for and/or access our Services; (ii) when you complete certain forms on the website or through the Application; (iii) when you upload or submit any material through the website or the Application; (iv) when you request information from us or contact us with inquiries; (v) when you wish to submit a request for medical services from a registered health care provider; and (vi) when you utilize the services of a registered health care provider.

    You may be asked to provide Personal Information and/or PHI in the following circumstances: (i) when you register for and/or access our Services; (ii) when you complete certain forms on the website or through the Application; (iii) when you upload or submit any material through the website or the Application; (iv) when you request information from us or contact us with inquiries; (v) when you wish to submit a request for medical services from a registered health care provider; and (vi) when you utilize the services of a registered health care provider.

    Examples of the type of Personal Information and/or PHI that we may collect from you includes: (i) name, phone number, date of birth, gender, address; (ii) history of presenting illness; (iii) medical history (including past medical history, family history, current medications and social history); (iv) credit card information; (v) medical license information (if health care provider).

    The foregoing information is required for you to utilize our Services, and for us to communicate with you, verify your identity and fulfill mandatory legal and regulatory requirements. By voluntarily providing us with the foregoing information, you are giving the Company permission to use and store your Personal Information and PHI consistent with this Privacy Policy.

    We may also obtain information about you from health care providers who register for our Services and are directly involved in providing medical services to you. We treat this information as PHI in accordance with this Privacy Policy.

    We only use or disclose your Personal Information and PHI in accordance with your express authorization, which we request from you through a separate document when you register to use our Services through the website or Application. If you do not provide authorization, or if you later revoke your authorization, you may not be able to use our Services through the website or the Application, but may continue to receive medical services from a health care provider outside of the website or the Application.

    You may modify or delete the Personal Information you have provided to us by logging in and updating your account. You are solely responsible for maintaining the accuracy and completeness of your Personal Information. We urge you to review your Personal Information regularly to ensure that it is correct and complete.   • Non-Personal Information. As is the case with most websites, when you visit our website, use the Application, or interact with us through the website or the Application, we receive, automatically track, and store certain Non-Personal Information about you (information that does not personally identify you), including but not limited to:

    • browser type;

    • IP address;

    • language preference;

    • cookies (see below);

    • domain servers;

    • URL traffic to, through, and from the website;

    • types of computers and operating systems accessing the website;

    • de-identified statistical information about the behavior of visitors to the website; and

    • any other website usage information that we may collect when you visit the website.

    This information, which may be collected passively using various technologies or through other means, cannot be used to specifically identify you. We may store such information itself or such information may be included in databases owned and maintained by our affiliates, agents or third party service providers. We may use such information and pool it with other information for administrative purposes, to assess the usage, value and performance of our products and services, to improve your experience with the Services and to track, for example, how visitors use and interact with the Services.

    Also, in an ongoing effort to better understand and serve users of our website, the Application and our Services, we may conduct research on customer demographics, interests and behavior based on information provided to Orunje by registered users. We may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners and to third parties for lawful purposes.

TECHNOLOGY (COOKIES)

Cookies are small pieces of information which are issued to your computer when you visit a website and which store and sometimes track information about your use of the Services. Orunje uses cookies to help recognize you as a repeat visitor, to improve the quality of our Services, and to try and make your browsing experience meaningful. When you enter our website, our web server sends a cookie to your computer which allows us to recognize your computer but not specifically who is using it. By associating the identification numbers in the cookies with other customer information when, for example, you log-in to the website or utilize our Services, then we know that the cookie information relates to you. Some of the cookies used by our Services are served by us, and some are served by third parties who are delivering services on our behalf. The use of cookies by any third parties, including our affiliates or service providers, is not covered by this Privacy Policy. We do not have access or control over those cookies.

By blocking or deleting cookies used on our website or Services, please note that you may not be able to take full advantage of our Services. ACCESSING OUR SERVICES

You may access the Services through our Application or our website. You and any health care providers, providing medical services to you, may download some of your Personal Information and PHI to personal devices through our website or our Application. You are responsible for maintaining the security of any mobile or personal devices you use to access the website or the Application. You are also responsible for maintaining the security of any Personal Information or PHI you download and save to any devices including computers, smartphones and tablets. Orunje advises you to only access or download Personal Information and PHI from personal devices within your control and while connected to secure network. Your health care provider’s use and disclosure of your Personal Information and PHI through our Services, including our website and the Application, is covered by their HIPAA Notice of Privacy Practices (see “HIPAA” below).

HIPAA

We may be regulated as a "Business Associate" under the Health Insurance Portability and Accountability Act (“HIPAA”). As a Business Associate, we agree not to use or disclose PHI other than as permitted in the Terms of Service, Privacy Policy, or as required by law. Personal Information, that does not come within the definition of PHI under HIPAA and is not restricted by HIPAA, will only be used and disclosed consistent with the terms of your authorization and this Privacy Policy.

Your health care provider may be regulated as a “Covered Entity” under HIPAA. Please be aware that this Privacy Policy is distinct and separate from your health care provider’s HIPAA Notice of Privacy Practices, which describes in detail, overall, how your health care provider uses and discloses your PHI. If you would like to review a copy of your health care provider’s HIPAA Notice of Privacy Practice, please request a copy directly from him or her.

HOW WE USE AND DISCLOSE YOUR PERSONAL INFORMATION

The protection of your Personal Information and PHI is our primary concern. Accordingly, Orunje only uses and discloses the Personal Information and PHI you provide in a manner that is consistent with this Privacy Policy or your express authorization. We will not sell, license, lease or otherwise disclose your Personal Information or PHI to any unaffiliated third party for any reason.

Orunje and its third-party service providers may use your Personal Information and/or PHI in the following ways:

  • To identify you when you sign-in to your account;

  • To administer your account;

  • To enable you to use our Services;

  • To carry out certain internal functions, including but not limited to, hosting services, IT services and infrastructure, customer service, account processing and data collection;

  • To monitor and analyze your use of our Services;

  • To communicate directly with you concerning your use of the Services;

  • To send you information we think you may find useful or which you have requested from us;

  • To present opportunities to you when you use the Services which we believe will be of interest based on your geographic location and previous use of the Services;

In addition, your Personal Information and/or PHI may be disclosed to:

  • To health care providers to schedule and fulfill your request for medical services through our website or Application, and for purposes of treatment and payment for medical services;

  • To our third party service providers for the purposes of furthering internal functions, including but not limited to, hosting services, IT services and infrastructure, customer service, account processing and data collection.

  • Federal and state authorities in the event of a suspected violation of law;

  • A third party pursuant to court order, subpoena and your express authorization;

  • A third party to protect the rights, privacy or property of you, our affiliates or us; and

  • In the event of a corporate sale, merger, reorganization, disposition or similar event, your Personal Information may be transferred to a third party. You will be notified via email and/or a prominent notice on our website and Application of any change in ownership or use of your Personal Information, as well any choice(s) you may have regarding your Personal Information.

EMAIL COMMUNICATIONS

While using our Services, you may receive the following types of email communication from our Company: (i) emails concerning your personal transactions; (ii) certain email notifications (forwarded messages, etc.) for which you may opt-out; (iii) service-related announcements on rare occasions when it is necessary or proper to do so; (iv) if you email us directly with a question or comment, we may email you back and keep a record of said email correspondence; and (iv) we may send you emails from time to time letting you know about special promotions and news about the Company or our Services. It is your responsibility to ensure that you maintain a current email address with Orunje, and to notify us if your email address has changed. We will try to keep all email communication to a minimum.

RETENTION OF PERSONAL AND NON-PERSONAL INFORMATION

We will retain your User Information (Personal Information and Non-Personal Information) for as long as your account is active or as needed to provide you Services. We may, however, retain certain Personal Information, including PHI, for a longer period of time as required by law.

HOW WE SAFEGUARD YOUR INFORMATION

We have developed appropriate safeguards to prevent the unauthorized use or disclosure of Personal Information and PHI, which include physical, administrative, and technical measures that reasonably and appropriately protect the confidentiality, availability, and integrity of the electronic PHI that has been created, received, maintained, or transmitted through our website, Application or our Services. Such safeguards include:

  • Encryption and authentication tools to maintain the confidentiality of your Personal Information and PHI including secure socket layer technology (SSL);

  • Limits on, to the greatest extent possible, who or what can access your Personal Information and PHI; and

  • Use of cookies to help (anonymously) recognize you as a repeat visitor and to track Site traffic patterns.

However, despite these efforts, please note that Orunje cannot ensure or guarantee the security of your Personal Information or PHI nor do we make any representation or warranty regarding the security of your account.

If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. We may also post a notice on or through the website and the Application in the event of a security breach. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

In the event of use or disclosure of PHI that is in violation of the requirements of HIPAA, the Terms of Service, or this Privacy Policy, we will mitigate, to the greatest extent practicable, any harmful effect resulting from the violation. Such mitigation may include:

  • Reporting any use or disclosure of PHI not provided for by the Terms of Service or Privacy Policy and any security incident of which we become aware to the health care provider; and

  • Documenting such use or disclosure of PHI and any related information that would be required for the Covered Entity to respond to a request for an accounting of the disclosure in accordance with HIPAA.

PUBLIC INFORMATION

Please keep in mind that some information you post or make available through the website, the Application or our Services, may be visible to all health care providers in your geographic area, and may be read, collected and/or used by others persons who access the Application. However, until a health care provider accepts your request for medical services, your Personal Information will not be released. We urge you not to place any Personal Information in the free text boxes available for you, when submitting a request for medical services. To request removal of your Personal Information from these publicly accessible areas, contact us at support@orunje.com. In some cases, we may not be able to remove your Personal Information and we will let you know if this is the case and why.

INTERNATIONAL USE PROHIBITED

Currently, our Services may not be accessed and/or used by persons located outside the United States. Accordingly, you acknowledge and agree that the laws of the United States govern this Privacy Policy, and our collection, use and disclosure of your Personal Information. We do not represent or warrant that our Services are appropriate for use in any particular jurisdiction. Furthermore, if you access our Services or submit any Personal Information from outside of the United States, you do so at your own risk, and are responsible for complying with any local laws, rules or regulations.

CHILDREN'S PRIVACY

Our Services are not meant for children under the age of 13. We do not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, please do not submit Personal Information through our website or Application. However, if you are a parent, legal guardian or personal representative of a child under the age of 13, you may, in compliance with our Terms of Service, use our Services on behalf of the child. Any information you provide to us on behalf of a child under the age of 13 will be considered Personal Information and will be subject to the terms provided in this Privacy Policy.

We encourage parents and legal guardians to monitor their children's internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information through our website or our Application without their permission. If you are a parent or legal guardian and have discovered that your child has a registered an account or has submitted any Personal Information through our website or Application, you may contact us, and we will delete that information from our databases. Similarly, if we discover that we have received any Personal Information from a child under the age of 13 without the permission of their parent, legal guardian or personal representative, we will use the information provided to notify the child that he or she cannot use the Services and subsequently delete any Personal Information provided from our databases.
